Mark practises in commercial and public law. 

Before coming to the Bar, Mark was an associate to the Hon Justice Crennan AC at the High Court of Australia and a solicitor at Allens.

Mark has degrees in commerce and law from the University of Adelaide and a Master of Law from the University of Cambridge. Mark studied at Cambridge as a Cambridge Trust Scholar and received the B R D Clarke Prize for Best Overall Performance in the LLM and the Gareth Jones Prize for Restitution.

Since coming to the Bar, Mark has advised and appeared on behalf of individuals, corporations and government agencies. Matters in which Mark has been briefed include:

Administrative and constitutional law

Brown v Tasmania (High Court of Australia): acted for the State of Victoria in a proceeding concerning the validity of a Tasmanian law regulating protest activity on business premises (led by Richard Niall QC, Solicitor-General of Victoria)

Setka v Magistrates’ Court of Victoria; Reardon v Magistrates’ Court of Victoria (Supreme Court of Victoria): acted for the plaintiffs in proceedings concerning the validity of charges brought under the Crimes Act 1987 (Vic) (led by Kris Walker QC, with Julia Watson)

Hoskin v Greater Bendigo City Council (High Court of Australia): acted for the respondent resisting an application for special leave to appeal in a case concerning the interaction between the Charter and the Planning and Environment Act 1987 (Vic) (led by Susan Brennan QC)

Chapple and Australian Securities and Investments Commission [2016] AATA 1032: acted for ASIC in an application for review of a decision permanently banning the applicant from providing financial services (unled)

CFMEU v Commissioner, Australian Federal Police (2015) 305 FLR 143; CFMEU v Commissioner, Australian Federal Police (No 2) [2017] ACTSC 10: acted for the plaintiff in a challenge to the execution of a search warrant by the Australian Federal Police (led by Peter Morrissey SC)

Pumpa v Goulburn Murray Rural Water Corporation [2015] VCAT 1101: acted for the applicants in a case concerning the limitation period applicable to a cause of action under the Water Act 1989 (Vic) (led by Jason Pizer QC)

Mark regularly appears in cases concerning judicial review of decisions made under the Migration Act 1958 (Cth).

Oswal v Australia and New Zealand Banking Group Ltd (Supreme Court of Victoria): acted for the lender and receivers in proceedings concerning the sale of mortgaged property (led by Matthew Connock QC, Justin Graham and Michael Rush)

Sayers Property Holdings Pty Ltd v Di Dio Nominees Pty Ltd (Supreme Court of Victoria): acted for the plaintiff in proceedings concerning an option to purchase property subject to an unregistered plan of subdivision (led by Paul Anastassiou QC)

The Pacrim ESP Pty Ltd v Terzini Motore Aust Pty Ltd (Supreme Court of Victoria): acted for the plaintiff in proceedings seeking specific restitution of a chattel, involving issues of agency and tracing (led by Paul Anastassiou QC and James Nixon)

AV Jennings Properties SPV No 9 Pty Ltd v Investa Elderslie Pty Ltd (Supreme Court of Victoria): acted for the defendant resisting an injunction in connection with the proposed sale of a business (led by David O’Callaghan QC)

Inquiries and investigations

Acted for the Hon Bill Shorten MP in connection with his appearance before the Royal Commission into Trade Union Governance and Corruption (led by Neil Clelland QC and others)

Acted as part of an independent panel appointed to conduct a review of the performance of PrimeSafe, the statutory authority responsible for the regulation of food safety in the meat, poultry and seafood industries in Victoria (led by Allan Myers AO QC and Andrew Hanak)

Acted for a local councillor in connection with an investigation by the Local Government Investigations and Compliance Inspectorate (led by Jack Hammond QC)
