International Law

Members of the International Law Section of CommBar have specialist expertise in private and public international law.  Our members provide advice on transactions with an international dimension, on international regulatory frameworks and problems involving conflict of laws.  We also offer experienced representation in Australian courts addressing international issues, and in international courts and tribunals.  Our clients include transnational corporations, Australian and foreign state enterprises, and foreign governments.

In the context of an emerging international legal market and the increasing importance of international law in the Australian legal environment, our knowledge of international law and of cross-border dispute resolution is drawn upon in the following areas:

    • International commercial arbitration
    • International sale of goods, carriage of goods by air and sea (Vienna Convention, Warsaw Convention, Hague Rules)
    • Advice on jurisdictional issues, including exercise of jurisdiction by Australian courts over foreign corporations and individuals, and status of foreign judgments in Australia
    • Transactions with foreign states, and status of foreign states and state entities before Australian courts (including foreign state immunity)
    • Advice on Australian laws with an international law element (eg Charter of Human Rights and Responsibilities which requires reference to international law and overseas judicial authorities)
    • Representation before international tribunals, including the International Centre for the International Settlement of Investment Disputes (ICSID); ICC International Court of Arbitration; the Singapore International Arbitration Centre (SIAC); the Australian Centre for International Commercial Arbitration (ACICA); and the Court of Arbitration for Sport (CAS).
