Maryanne Loughnan, S.C. - Chair

Maryanne was admitted to practice in 1983 and signed the Bar Roll in 1989.  She practises in most areas of commercial dispute in the superior Courts.  Her particular areas of practice are banking and financial services, credit law, trade practices, property and sale of land, franchises, insurance and commercial leases.  She has a depth of experience in all aspects of work associated with such matters including drafting of pleadings, advice, injunctions, mediation, trial preparation, the conduct of trials and appeals.  Maryanne has a special interest in banking and finance.  She is a member of the Executive of the Commercial Bar Association and the Editor of the Commercial Bar Association newsletter.

Andrew Kirby - Deputy Chair

Since signing the Bar Roll in 1999 Andrew has appeared in commercial cases in all superior Courts in the following areas: banking & finance - acting for and against financial institutions in matters involving debt recovery and security enforcement, priority issues and cheque conversion cases; compliance issues and financial services matters; property; equity and trusts and corporations and insolvency matters.  Before coming to the Bar, Andrew completed articles and one year's practice as a solicitor at Blake Dawson Waldron in the Commercial Litigation and Banking and Finance Departments.  He also worked for three and a half years at Bankers Trust in Melbourne and London as an investment banker working on financing transactions, including leveraged buy-outs and high yield bonds, and also the analysis of company cash flows and valuations.

 

Garry Moffatt - Co-Secretary and Monitor

Garry was admitted to practice in 1980.  In 1991 he was appointed the Head of Litigation in the Legal Department of the Commonwealth Bank of Australia.  Garry signed the Bar Roll in 2005 and is experienced in the conduct of commercial litigation in all courts.  Garry also practised in insurance litigation for CBA as Defendant, with a particular focus on claims involving total and permanent disablement, occupier's liability and life insurance.  Garry practises principally in the areas of banking and finance, bankruptcy, insolvency and insurance litigation.

 

Samantha Cipriano - Co-Secretary and Monitor

Samantha was admitted to practice in 2000 and signed the Bar Roll in 2001. She has a commercial practice, specialising in banking and finance, credit law, bankruptcy and insolvency. Samantha has acted for financial institutions in matters such as enforcement of securities, fraud, cheque conversion, removal of caveats and Proceeds of Crime legislation.Samantha appears for creditors (particularly banks), liquidators, receivers and administrators in relation to company administrations, uncommercial transactions, winding up and bankruptcy matters. Samantha has also advised and appeared on a broad range of commercial matters including trade practices and disputes over contracts of sale of land, caveats, restrictive covenants and easements.

 

Thomas Warner - Monitor

 

Thomas has a broad ranging commercial litigation practice, with a particular emphasis upon corporations and banking & finance related disputes.  He is regularly briefed to both advise and appear for banks, non-bank financiers and corporate borrowers.

Prior to signing the bar roll in May 2009, Thomas worked as a solicitor at Corrs Chambers Westgarth in Melbourne and Allen & Overy in London.  He was also previously Associate to Justice Vickery in the Supreme Court of Victoria.  

Thomas is a member of the Banking & Finance Practice Section of the Commercial Bar Association and the County Court’s Banking & Finance Division Users’ Group.
